Terms of Service

Welcome to Violation Leads NYC ("we," "us," or "our"). By requesting a free trial or subscribing to our service, you agree to these Terms of Service. Please read them carefully.

1. Service Description

Violation Leads NYC provides a subscription-based lead generation service for licensed NYC master plumbers. We deliver:

• NYC building addresses with active Class C violations (heat, hot water, boiler access)
• Building owner contact information (phone and/or email) obtained via legal skip-tracing
• Data sourced from public NYC Housing Preservation & Development (HPD) records
• Leads filtered by your chosen borough(s) and delivered to a private Google Sheet
• Up to 100 exclusive leads per month per borough subscribed

2. Eligibility

Our service is available exclusively to licensed master plumbers operating in New York City. By subscribing, you represent that you hold a valid NYC master plumber license. We reserve the right to verify licensure and terminate service if eligibility cannot be confirmed.

3. Free Trial

We offer a 7-day free trial with no credit card required. During the trial:

• You receive an initial batch of exclusive leads delivered to a private Google Sheet
• No charge is incurred during the trial period
• After 7 days, you may choose to subscribe or discontinue with no obligation
• We reserve the right to limit free trials to one per individual or business

4. Subscription Plans & Pricing

• Subscriptions renew automatically on a monthly basis until canceled
• Founding member rate ($997/month) is locked for life for qualifying early subscribers and will never increase as long as the subscription remains active
• Standard rate subscribers will receive 30 days' notice of any pricing changes
• Borough coverage is set at signup; changes to borough selection may affect pricing

5. Lead Exclusivity

Each lead is delivered to one subscriber only. Our system tracks every delivered lead by violation ID to ensure no lead is ever sent to more than one subscriber. This exclusivity is enforced technically, not just by policy. Leads delivered to your sheet will not appear in any other subscriber's sheet.

6. Lead Volume Guarantee

We commit to delivering a minimum of 80 leads per subscribed borough per month. If we fall short of this threshold in any calendar month, we carry the shortfall to the following month at no additional charge. We do not guarantee specific contact rates, response rates, or job conversion outcomes.

7. Payment Terms

• Billing: Monthly subscription fee billed in advance via Stripe
• Auto-Renewal: Your subscription renews monthly unless canceled before the renewal date
• Payment Methods: Major credit and debit cards via Stripe
• Failed Payments: Service may be suspended after 3 days of non-payment; canceled after 7 days
• Founding Member Rate: Rate is locked only while the subscription remains continuously active. Cancellation and re-subscription forfeits the founding rate

8. Refund Policy

Due to the nature of data delivery, all payments are generally final and non-refundable except as follows:

• If we deliver fewer than 80 leads in a given month for a subscribed borough, we will carry the balance to the next month
• We do not issue cash refunds for months where the minimum lead threshold was met
• We do not guarantee specific conversion or contact rates

9. Cancellation

• You may cancel your subscription at any time by emailing dennis@violationleads.co
• Cancellation takes effect at the end of your current billing period
• No partial refunds are issued for unused days in a billing period
• Founding member rate is forfeited upon cancellation

10. Acceptable Use of Lead Data

Lead data is provided for legitimate business outreach by licensed master plumbers only. You agree to:

• Use lead data solely to contact building owners about licensed plumbing and related services
• Comply with all applicable federal, state, and local laws including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
• Not resell, redistribute, or share lead data with third parties
• Not use lead data for any purpose other than direct business outreach
• Honor do-not-contact requests from building owners promptly

11. Data Sources & Accuracy

Violation data is sourced from public NYC HPD records. Contact information is obtained via licensed skip-tracing services. While we make reasonable efforts to ensure accuracy and freshness, we do not warrant that:

• All contact information is current or accurate
• All violations are still open at the time of delivery
• Building owners will be reachable or responsive

12. Limitation of Liability

Violation Leads NYC is not liable for any indirect, incidental, or consequential damages arising from your use of our service or lead data. Our total liability shall not exceed the amount paid by you in the most recent billing period.

13. Modifications to Terms

We may update these Terms from time to time. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in Miami-Dade County, Florida.
